The Services are provided by CMC Telecommunication Infrastructure Corporation (“CMC Telecom”), headquartered at CMC Tower, No. 11 Duy Tan Street, Dich Vong Hau Ward, Cau Giay District, Hanoi City. By using our Services, you agree to the following terms. Please read these terms carefully.
These terms of service are established by CMC Telecom to ensure both customers and CMC Telecom avoid violations of applicable laws of the Socialist Republic of Vietnam, while also helping customers secure their personal information and all data during the use of CMC Telecom’s products and services. By creating an account and using our services, the customer is deemed to have fully agreed to and accepted these Terms of service.

– CMC Telecom commits to providing services as outlined in its “Service Level Agreement” and complying with its “Privacy Policy” as published on its official websites.
– CMC Telecom shall not be liable for any violations related to prohibited uses outlined in Section 3 of these terms.
– CMC Telecom shall not be responsible forany customer content/data stored on its systems.
– CMC Telecom shall not be responsible for any violations of the provisions set forth in the Law on Cybersecurity No. 24/2018/QH14 enacted by the National Assembly of the Socialist Republic of Vietnam made by customers.
– CMC Telecom shall not have any obligations to monitor or control user activities and disclaims any liability for the abuse or misuse of CMC Telecom’s network system by users.
– CMC Telecom shall not support intervention, modification, or development of customer website source code or troubleshooting incompatible server configuration issues.
– CMC Telecom shall not assist in managing customer website content.
– CMC Telecom shall ensure to receive customer support requests through the following contact methods:

– Strictly comply with the Constitution and Laws of the Socialist Republic of Vietnam.
– Strictly comply with and take responsibility in accordance with the Cybersecurity Law No. 24/2018/QH14 issued by the National Assembly of the Socialist Republic of Vietnam.
– Customers shall take full responsibility for any violations of the unacceptable use of servicesspecified in Section 3 of this Terms.
– Customers are required to provide contact information fully and accurately, including full name, address, email, and phone number. When necessary (as stipulated by law and depending on the type of services), customers must also provide relevant documents upon request by CMC Telecom (such as a copy of ID card or other official documents). In cases where the customer requests to transfer/supplement the management rights/ownership of their in use account /service packages, the customer must ensure that their contact information is fully and accurately updated in CMC Telecom’s management system.
– Customers must keep secure all their identification information, passwords, or other confidential information related to their account. Immediately notify CMC Telecom upon detecting any unauthorized access to the customer’s account or any security vulnerabilities, including but not limited the loss, theft, or disclosure of passwords and other confidential information.
– Customers are responsible for securing their access devices, including the use of personal security software such as antivirus software and firewalls software.
– Customers are responsible for maintaining and preserving their data stored on servers.
– The customer shall commit to providing truthful and accurate feedback regarding the quality of CMC Telecom’s products and services on all media channels, websites, forums, etc., and all feedback must be accompanied by valid evidence. CMC Telecom reserves the right to unilaterally terminate the contract if any feedback is found to be inaccurate, defamatory, or damaging to the reputation of the service provider.
3.1. Server and Network Violations:
− Storing documents, disseminating information, using or storing harmful programs such as viruses, worms, trojans on CMC Telecom’s server systems.
− Using CMC Telecom’s services for attacks, unauthorized access, or data interception on websites or servers of other user or other service provider.
− The intervention that changes the control system, resource monitoring, and log files affects the management and operational processes of CMC Telecom.
− Using source code that causes system overload or excessively consumes resources beyond the specified limits of the service package.
– Sending emails in any form with the intention of causing harm or spreading spam, including programs that send emails exceeding the specified limit (100 emails/hour).
3.2. Content Violations:
The customer is not allowed to store or disseminate information and documents that violate the Laws of the Socialist Republic of Vietnam and international regulations applicable in Vietnam, including:
− Intend to propagate or criticize political issues related to the reactionary movements
− Military equipment instructions
− Using offensive language that violates ethical standards and traditional Vietnamese cultural values
− Pornographic, propagating obscene content
− Infringement of legal regulations of patent , trademarks, design rights, copyrights, or any intellectual property rights or other rights of any individual.
− Data that is illegal, threatening, deceptive, or in other prohibited forms.
− Data that constitutes or encourages type of crime
− Disclosure of trade secrets or personal information, secrets, or exclusive information belongs to others
3.3. Security Violations:
Customers are not allowed to engage in unlawful, abusive, or irresponsible behaviors, including:
− Unauthorized access to or use of data, systems, or networks includes any activity involving probing, scanning, or testing for system vulnerabilities, or breaching security and authentication measures without the consent of the network owner (including website visitors and customers using products or services provided by CMC Telecom)
− Monitoring data or traffic on any network or system without the permission of the owner of that system or network.
− Using an Internet account or computer without the owner’s authorization, such as password scanning, tricking others into revealing their passwords, stealing passwords, scanning for security vulnerabilities, or accessing login portals.
− Any act of forging TCP-IP or any part of the email header in an email
4.1. Payment:
Customers are resonsible for paying all service charges in full and on time incurred when using CMC Telecom services. CMC Telecom will notify customers at the following stages:
– Upon invoice issuance (notified via email)
– Upon payment deadline with service suspension
– Before permanent deletion (15 days post-invoice if unpaid) (notified via email)
Upon receiving the notification requesting payment for service charges, the customer must pay the full amount to avoid the risk of service interruption or loss when the service expires.
4.2. Refunds:
Refunds are only issued if CMC Telecom ceases to provide the prepaid service. If the fault is not attributable to CMC Telecom, all service charges shall be non-refundable.
4.3. Regulation on Service Configuration Changes:
During the term of service, if the Customer needs to change the server configuration (either increasing or decreasing part or all of the initial configuration), the Customer will make the changes on CMC Telecom’s system through their account. The service charges that the Customer must pay to CMC Telecom will be calculated based on the service price list for the corresponding server configuration of CMC Telecom. Within the first 3 days of the month following the month in which the changes occur, the Customer is responsible for reviewing and confirming the change statistics and service charges for the previous month as recorded in CMC Telecom’s system. If the Customer does not confirm the information by the stated deadline, the information will be deemed accurate and used as the basis for CMC Telecom to issue an invoice, and the Customer will fulfill their payment obligation.
5.1. Suspension:
CMC Telecom shall suspend service in the following cases:
– More than 10 days overdue payment from the invoice issuance date.
– The customer violates the forms of use in Section 3 of this agreement
– Customers provide incorrect information (name, phone number, etc.) in order to find ways to fraudulently use or make payments
– Suspicious accounts such as: multiple accounts sharing one phone number, similar accounts
– Other cases defined by CMC Telecom
5.2. Permanent Deletion:
Services will be permanently deleted in the following cases:
– More than 15 days overdue payment from the invoice issuance date.
– The customers violate the forms of use as specified in Section 3 of this Terms of Service.
– Customers provide incorrect information (full name, phone number, etc.) in order to fraudulently use or make payments
– Suspicious accounts such as: multiple accounts sharing one phone number, similar accounts
– Other cases as defined by CMC Telecom.
– The default virtual server service packages shall not include data backup services. Therefore, customers are kindly requested to contact the CMC Telecom customer support team for guidance on how to perform data backups directly on the server or to add a data backup service package if necessary. CMC Telecom shall not be responsible for any incidents related to data backups caused by external factors such as terrorism, natural disasters, fires, etc. Backup services will not be provided for accounts that have been suspended or permanently deleted for any reason, unless there is a written agreement between both parties.
– CMC Telecom only supports full backups (e.g., source code folders, the folder containing emails, or the entire databases) or provides backup copies for customers to handle themselves. We do not perform data recovery for individual files upon the customer’s request.
If CMC Telecom is sued due to customer violations, the customer shall be responsible for all related costs, including damages and legal fees.
In any event, CMC Telecom shall not take any responsibility for indirect, incidental, or consequential damages, including but not limited to damage in profit and revenue, business opportunities, or data loss. CMC Telecom’s total liability shall not exceed the amount that the Customer has paid for the service within one year from the time of arising CMC Telecom’s liability.
CMC Telecom may change, amend, supplement, or replace the content of the Terms of Service at any time to comply with the laws of the Socialist Republic of Vietnam. Any changes will take effect once they are published on the website.: https://cmctelecom.vn
